16 June 2009 Farmers fined 14,000 for moving sheep illegally

Leicestershire County Council Trading Standards Service has prosecuted two Leicestershire farmers for failing to comply with a prohibition notice previously issued to them about moving their sheep.

Thomas Geoffrey Skinner and Joseph David Skinner trading as the Skinner Brothers of Hazeltongue Farm, Holwell, Leicestershire were each fined £7,000 plus costs of £187.79 for failing to obtain individual movement licences when moving sheep off their farm.

Movement licences were made a legal requirement after the Foot and Mouth Disease outbreak in 2001, in order to improve the traceability of sheep and goat movements in the event of another major disease outbreak.

All farmers are automatically allowed to move sheep under General Licence controls. As part of this they are required to complete a declaration each and every time they move their sheep. The Skinner Brothers had failed to do this on a number of occasions since 2005 and had received advice and warnings from the Trading Standards Service. In September 2008, the Divisional Veterinary Manager issued them with a Prohibition Notice, under which they had to obtain Individual Movement Licences from the Trading Standards Service each time they wanted to move any sheep off their holding. They failed to do this on 7 occasions in October and November 2008.

David Bull, Head of Trading Standards for Leicestershire County Council said, “This case was the first of its kind in the East Midlands and resulted from repeated failure to comply with the law. Tracing livestock movements is an essential part of disease control. It is crucial therefore that all farmers follow the legal requirements otherwise they may be putting their own and their industry’s prosperity at risk. This case demonstrates that failure to follow the rules will be investigated and can lead to the imposition of significant sanctions by the courts”.

Further Information:

(1)The case was heard in Melton Mowbray Magistrates Court on 10/06/2009.  Thomas Geoffrey Skinner and Joseph David Skinner, t/a Skinner Brothers, pleaded guilty under the Disease Control (England) Order 2003 by virtue of the Animal Health Act 1981 for;

  • Failing to obtain an individual movement licence for the movement of sheep on 7 separate occasions.

(2) The Skinner Brothers were fined £7000 each and ordered to pay costs of £187.79 each to the County Council.

(3) A Prohibition Notice was issued to the Skinner Brothers for failing to provide completed Animal Movement Licence (AML) documents for the movement of sheep off their premise in breach of their General Licence conditions on 3 separate occasions.

(4) The Prohibition Notice was the first to be issued in the East Midlands along with the first prosecution of its kind within the region.

(5) All movements of sheep must be accompanied by an AML movement document which lists details relating to the departure premises, date of departure, destination premises, date of destination, transportation details and number of sheep moved.  

(6) This AML movement document is available free of charge to farmers. A copy of this document must be sent to the local authority of the destination premises to be recorded in the Animal Movements Licensing System (AMLS) to enable traceability.

(7) In the event of a disease outbreak, the traceability of all livestock is essential for effective measures to control and eradicate highly contagious or Zoonotic diseases (diseases that can be passed on to humans).

(8) The Animal Health Act 1981 provides on summary conviction, to a fine not exceeding the statutory maximum or imprisonment not exceeding six months or to both.
