15 May 2009 Cattle Have Lost Their Way!

John Andrew Hawley, trading as Leicestershire Livestock, of Six Hills Farm, Six Hills, Leicestershire was fined £3000 and ordered to pay costs of £1400 for failing to report and record deaths and movements of his cattle and for not having the required information present in cattle passports. He was also unable to account for 23 cattle which appeared to have disappeared without trace from his premises.

Trading Standards Officers and Defra Investigation Services visited the farm in July 2008 and seized hundreds of cattle passports which did not comply with legal requirements designed to control animal disease and protect the human food chain.

All cattle are required to have their own passport and two ear tags bearing a unique identification number. Farmers are required to keep records of all the cattle that move on and off their farms. This provides for traceability throughout  an animal’s life and on into the human food chain. Such controls are crucial to ensure that only healthy and disease free animals are put onto the market for human consumption and to protect the farming industry when a disease outbreak occurs. When this happens it is essential that the correct movement history of animals is known so as to be able quickly to eradicate and prevent the further spread of disease.

David Bull, Head of Leicestershire County Council Trading Standards Service said “It is important that all farmers follow the rules to ensure that the beef we eat is fit to be in the food chain. These legal requirements help the authorities to trace and control the source of any outbreaks of disease such as BSE, Foot and Mouth and Bluetongue. Accurate traceability of cattle movements is critical. This successful case sends out a clear message to the farming community; you can expect significant sanctions when you do not comply with the law and put at risk  the prosperity of your industry and the food we eat.”

Notes to Editor:

(1) The case was heard in Melton Mowbray Magistrates Court on 13/05/2009.

John Andrew Hawley, T/A Leicestershire Livestock, pleaded guilty under the Cattle Identification Regulations 2007, for:

  • failing to notify the death of cattle to the secretary of state within 7 days,
  • failing to record the death of cattle within 7 days,
  • failing to notify the movement onto his holding of cattle to the secretary of state within 36 hours,
  • failing to record the movement of cattle onto his holding within 36 hours,
  • failing to mark the passport of cattle with the date of the movement onto the holding, the name and address of the keeper and the holding number, within 36 hours

(2) Mr Hawley was fined £3000 and ordered to pay £1400 in costs to the County Council.

(3) The visit was made to the premise of Mr Hawley as part of Operation Zebra. The operation was undertaken as result of regional intelligence work targetinge concerned with the possibility of cattle Identification fraud.

(4) Cattle must be accompanied throughout their life by a passport confirming their identification details; sex, breed, date of birth, identification of the mother and record of their movement history. These must be returned to the British Cattle Movement Service (BCMS) once an animal dies.

(5) Details of all births, movements between holdings (farms, markets and slaughterhouses) and deaths of individual cattle must be notified as they happen to the central Cattle Tracing System (CTS) computer database run by BCMS, part of the Rural Payments Agency (RPA).

(6) Cattle keepers must also keep an up-to-date, accurate herd register of the cattle on their holding. In this they must record ear tag identification numbers, breed and sex, dates of births, deaths and movements on and off their holding, together with details of where the cattle came from or went to, and the identification of the mother

(7) Cattle identification and traceability is a vital part of disease control. Due to the problems and lack of consumer confidence caused by the Bovine Spongiform Encephalopathy (BSE) crisis, the Foot and Mouth Disease crisis and the recent outbreaks of Bluetongue Disease, traceability is now even more closely controlled. The legislation in force is a requirement of a European Regulation (Regulation (EC) No 1760/2000) placed on all member states to ensure they implement a system of registration, identification and traceability.

(8) In the event of a disease outbreak, the precise location of all livestock is essential for effective measures to control and eradicate highly contagious or Zoonotic diseases (diseases that can be passed on to humans).

(9) The Cattle Identification Regulations 2007 provide for on summary conviction, to a fine not exceeding the statutory maximum or to imprisonment not exceeding three months or to both; or on conviction on indictment, to a fine or to imprisonment for a term not exceeding two years or to both.
